KesstiPart 1: Restaurant owners and staff (Kessti subscribers)
This part applies if you create a Kessti account to manage a restaurant's operations: point of sale, orders, kitchen display, reservations, website, loyalty program, or related tools.
Your account
You're responsible for keeping your login credentials and any staff PIN codes confidential, and for all activity that happens under your account. If you're an owner, you're responsible for the staff accounts you create and for how your staff use Kessti.
Subscription and billing
Kessti is offered on subscription plans (Starter, Growth, and Scale), each including a different set of features, as described on our pricing page. New accounts can start with a 1-month free trial, with no credit card required to begin. After the trial, continuing to use Kessti requires selecting a paid plan. We may change plan features or pricing over time; if we do, we'll make reasonable efforts to notify existing customers before changes take effect.
Acceptable use
You agree to use Kessti only for legitimate restaurant and hospitality business purposes, and not to: use the platform to violate any applicable law; attempt to gain unauthorized access to another restaurant's data or account; interfere with or disrupt the platform's operation; or use the platform to collect or store personal data you're not legally permitted to collect.
Your data
You retain ownership of the data you and your customers generate through your use of Kessti: your menu, orders, customer records, and related business data. We process this data on your behalf to provide the service, as described in our Privacy Policy. You're responsible for the accuracy of the information you enter and for complying with any laws that apply to how you collect and use your own customers' data.
Service availability
We aim to keep Kessti available and reliable, including offline support in the point-of-sale app for temporary connectivity loss, but we don't guarantee uninterrupted availability. We're not liable for losses resulting from service interruptions, scheduled maintenance, or factors outside our reasonable control.
Suspension and termination
We may suspend or terminate an account that violates these terms, engages in fraudulent activity, or poses a security risk to the platform or other users. You may stop using Kessti at any time and request account closure through our Support page
Part 2: Restaurant customers (diners)
This part applies if you order food, make a reservation, or join a loyalty program through a specific restaurant's page powered by Kessti.
Your relationship is with the restaurant
When you place an order, make a reservation, or join a loyalty program, your agreement for that order, reservation, or loyalty program is with the restaurant itself, not with Kessti. The restaurant is responsible for the food, service, pricing, reservation policies, and any loyalty rewards it offers. Kessti provides the technology the restaurant uses, but doesn't prepare food, staff the restaurant, or set its policies.
Orders and payment
Orders placed online or by QR code are sent directly to the restaurant. Depending on the restaurant, you may pay in person (cash or card) or by another method the restaurant offers. Kessti does not store your payment card details.
Reservations
Reservation policies (such as cancellation windows or large-party requirements) are set by the individual restaurant, not by Kessti. If you need to change or cancel a reservation, contact the restaurant directly where possible.
Loyalty programs and rewards
If a restaurant offers a loyalty program, the points, tiers, and rewards it offers are set and funded by that restaurant, not by Kessti. Kessti provides the system used to track and redeem points, but loyalty terms (such as expiration or eligibility) are set by the restaurant.
Accounts and accuracy of information
If you create a customer account with a restaurant, you agree to provide accurate contact information, since it's used to confirm orders and reservations. You're responsible for keeping your account credentials confidential.
General terms
These terms are governed by the laws applicable in Tunisia, where Kessti is currently focused. We may update these Terms of Service from time to time; continued use of Kessti after an update means you accept the revised terms. If any part of these terms is found unenforceable, the remaining parts continue to apply.
